  1. The customer acknowledges receipt of the equipment identified above (the “Equipment” which was examined by the customer and found to be in good workable condition upon receipt (except as noted below).  The customer further acknowledges that the equipment is leased by Banderas Bay Carts to the customer for the use and purpose for which it was manufactured subject, however to the terms and conditions set forth herein.
  2. The customer shall return the equipment to the pick-up location no later than the date and time specified above (THE CUSTOMER SHALL CONTACT LESSOR IF AN EXTENSION OF TIME IS DESIRED) or upon Banderas Bay Carts’ demand therefore.
  3. The equipment shall be returned in the same condition as when received, ordinary wear excepted.
  4. The customer shall pay to Banderas Bay Carts, upon demand, rental for the equipment at the rates provided until the equipment is returned to Banderas Bay Carts.  Daily rates will apply unless other arrangements are made with Banderas Bay Carts in advance.  Daily rates will apply if the equipment is kept after the scheduled return date.  All days including weekends and holidays are chargeable.
  5. The customer shall reimburse Banderas Bay Carts, upon demand for the loss of, or any damage to the equipment or property damage while it is rented to the customer and for all costs and expenses, including reasonable attorney’s fee, incurred by Banderas Bay Carts in collecting and amounts owing by the customer hereunder or in otherwise enforcing Banderas Bay Carts’ rights hereunder.
  6. The customer shall indemnify and hold Banderas Bay Carts harmless from and against any and all liability, including bodily injury and property damage, arising out of the use or operation of the equipment by the customer or anyone using or operating the same with the customer’s express or implied consent: provided, however, that Banderas Bay Carts shall be responsible for loss or damage resulting from Banderas Bay Carts sole negligence. The customer shall abide by all rules and regulations of Banderas Bay Carts governing the use of the equipment.
  7. The customer shall notify Banderas Bay Carts directly when the customer is changing residence to another address.
  8. ONLY HOLDERS OF A VALID DRIVER’S LICENSE 18 YEARS OF AGE AND OLDER MAY OPERATE THE EQUIPMENT.  Moped license, learner’s permit, etc are not accepted.
  9. The customer shall not assign the Rental Contract or sublease the equipment.
  10. Golf Carts operated after sunset must have lights turned on.
  11. Golf Carts must be operated properly. Horseplay, racing, using the cart to push or pull any other vehicle, or other misuse of cart will not be tolerated.
  12. Carts are to be operated on public and resort roadways only and not on the public highways or restricted areas.  No off-road riding and absolutely no use on beaches.  Please refer to map on the website for restricted and dangerous areas
  13. Golf Carts can carry a maximum of 4 people and all passengers must always be seated when cart is in motion.  The vehicle capacity is 800 pounds and is never to be overloaded.
  14. Golf Carts must be returned to the pick-up location at the designated time.  Late returns of cart will be charged $10 every half hour late.
  15. Open alcohol on the golf cart is not permitted and drinking and driving is against the law.  Open alcohol or being under the influence while driving will result in the immediate loss of rental privileges and all payments for the rental of the golf cart,
  16. The Customer is not allowed to repair any damages on the vehicle or hire somebody to repair them.
  17. A fee of $500 will be charged if the cart engine governor is tampered with or modified during the rental.  Do not modify any of the factory settings (ie the governor accelerator cable etc) on the engine.  Modifications can result in damage to the vehicle (s) as well as incurring additional fees.  All vehicles are checked for correct working order before delivery, and after pickup.
  18. Please report any malfunctions to management immediately.
  19. Anyone found abusing the rules and regulations of the rental golf cart would forfeit all rental privileges.  There will be no refunds made if the cart has to be returned because of the customer misuse.  Loss of security hold will also result if cart is misused or damaged.  There are no second chances.
  20. In case of theft, an accident or fire the customer shall immediately notify Banderas Bay Carts, and the police or security company (if on a resort property).  The customer shall not abandon the vehicle to safe guard it and all its accessories.  The customer has the obligation to pay the deposit mentioned in the rental agreement.  If the customer is innocent in case of an accident and the other party has insurance which cover damages Banderas Bay Carts will return the money (or the part the renter is entitled to) to the customer as soon as possible.  Any failure of this condition will stop all insurance conditions and will make the renter fully liable for all damages and costs.
  21. Lost keys will incur a monetary charge of $10. Unreturned locks will incur a $30 fee.
  22. Carts returned dirty will be charged a $20 cleaning fee.

 

Operation and Care of Golf Cart:

Please remember that a golf cart is a vehicle and as such can pose a danger to people and property.  Please try and observe the following instructions.

  1. Park the vehicle on level ground whenever possible with the parking brake applied.
  2. Never switch between forward and reverse until the vehicle is fully stopped and your foot is off the accelerator.
  3. Please take the key out of the ignition and install the steering lock cable when leaving the cart for any extended time. Whenever possible when parking the cart for the night keep the golf cart on private property.
  4. When operating on rough roads, dirt or cobblestone please keep the speed down for the security of the occupants, the vehicle and people/property in the immediate vicinity.
